Lane & Waterman Secures Defense Verdict in Chiropractic Malpractice Jury Trial

Lane & Waterman attorneys Abbey Furlong and David Waterman successfully defended their client, a Cedar Rapids chiropractor and his practice, in a professional malpractice lawsuit. The Plaintiff alleged that a March 2018 cervical adjustment caused him to suffer a vertebral artery dissection and stroke, resulting in permanent injuries. He further claimed the doctor failed to obtain his informed consent before performing the adjustment to Plaintiff’s cervical spine. The Plaintiff requested an award of approximately $600,000 in damages.
The defense presented evidence that the dissection predated the chiropractic visit, that the care provided was reasonable and did not cause any of the plaintiff’s injuries, and that the written consent form was appropriate. After a four-day jury trial, the jury deliberated for approximately one hour before returning a verdict in favor of the chiropractor and his practice on all claims.
