Lane & Waterman Secures Defense Verdict in Wrongful Death Jury Trial


Bob Waterman Jr. and Grace Mangieri successfully defended their client, a Galesburg, Illinois nursing home, against claims of negligence under the Illinois Nursing Home Care Act and wrongful death of a 52-year-old woman.
The Plaintiff alleged the nursing home’s negligent care, including failure to provide proper nutrition, hydration, and medical treatment, caused the Plaintiff’s Decedent to suffer dehydration and malnutrition. The Plaintiff further claimed the foregoing proximately caused or contributed to the Decedent’s death.
The defense presented evidence that the Decedent was properly cared for, that the care provided was reasonable, and that it was not the cause of the Decedent’s injuries or death.
At the close of evidence, the Plaintiff requested an award of $1.75 million. After an hour and a half of deliberation, the jury returned a defense verdict.
