Lane & Waterman negotiates multi-million dollar class action settlements

Richard Davidson Attorney At LawTerry Giebelstein Attorney At LawLane & Waterman attorneys Richard A. Davidson and Terry M. Giebelstein have successfully negotiated settlements on behalf of the classes in two class action lawsuits against the City of Sioux City, Iowa and the City of Dubuque, Iowa.

In the case of Sweisberger v. Sioux City, Iowa, Sioux City agreed to pay the class $6.475 million as a refund for excess gas and electric franchise fees Sioux City collected from September 2001 to May 2009. A final order and judgment approving the settlement was issued November 14, 2014 by the Honorable Jeffery A. Neary of Iowa’s Third Judicial District.

In the similar case of Zaber v. City of Dubuque, Iowa, the City of Dubuque agreed to pay the class $2.6 million as a refund for excess gas and electric franchise fees charged by the City of Dubuque. The Honorable Michael J. Shubatt of Iowa’s First Judicial District entered an order preliminarily approving the settlement on December 26, 2014.
