Furlong and Juehring successfully defend Eastern Iowa company
Abbey Furlong and Jenny Juehring successfully defended an Eastern Iowa company in a federal employment dispute arising out of an employee’s termination due to excessive tardiness and poor attitude. The Plaintiff claimed her termination was the result of retaliation for taking FMLA leave to care for her mother while she recovered from knee surgery. The Plaintiff requested in excess of $75,000 in back wages along with reinstatement and/or front pay. The Defendant company presented evidence that its termination decision was unrelated to Plaintiff’s FMLA leave and that her own actions and conduct were what led to her termination. After a four-day jury trial in the United States District Court for the Northern District of Iowa, the jury returned a verdict in favor of the Defendant company, finding it would have terminated Plaintiff’s employment regardless of the fact that she took FMLA leave.
