Bob Waterman and Abbey Furlong Successfully Defend Eastern Iowa Chiropractor Against Malpractice Lawsuit
Bob Waterman and Abbey Furlong successfully defended an Eastern Iowa chiropractor in a professional malpractice action. The plaintiff alleged a chiropractic adjustment caused him injury but failed to submit the required certificate of merit affidavit from a qualified expert in support of his allegations. The Iowa District Court for Scott County entered an order granting the defense’s motion to dismiss. In dismissing the lawsuit, the Court rejected plaintiff’s argument that expert testimony was not required to support his claim of professional malpractice. The Court instead found that “without any expert testimony, the plaintiff cannot establish a causal connection between the defendant’s actions and his injury,” leaving the plaintiff unable to pursue his claims.
