O’Rourke, Barnett, and Juehring obtain dismissal of a putative class action for the City of Davenport
Lane & Waterman attorneys Jason O’Rourke, Alex Barnett, and Jenny Juehring on behalf of the City of Davenport successfully obtained the dismissal of a putative class action lawsuit brought by several individuals and businesses arising out of the historic flooding of downtown Davenport in April 2019. The plaintiffs sought millions of dollars in damages. O’Rourke, Barnett, and Juehring filed a motion on behalf of the City of Davenport to dismiss the lawsuit. The Iowa District Court for Scott County granted the motion and ruled that the lawsuit was time-barred as it was filed nearly five years after the flood and an Iowa statute required that the lawsuit be filed within two years of the flood.
